The Legal Framework: The Domestic Violence Act
What the Domestic Violence Act Covers
The Domestic Violence Act 116 of 1998 defines domestic violence broadly to include physical abuse, sexual abuse, emotional, verbal, and psychological abuse, economic abuse, intimidation, harassment, stalking, damage to property, and any other controlling or abusive behaviour. The Act applies to people who are or were in a domestic relationship, which includes married couples, people living together, people in dating relationships, parents of children, family members, and people who share a household.
What a Protection Order Does
A protection order is a court order that prohibits the respondent from committing acts of domestic violence against the complainant. Depending on the circumstances, a protection order can also prohibit the respondent from contacting the complainant by any means, from coming within a specified distance of the complainant’s home or workplace, from entering the shared home, and from dealing with any shared assets in a way that prejudices the complainant. A protection order is enforceable by the South African Police Service, and breach of a protection order is a criminal offence.
The Protection Order Process
Interim Protection Orders
A complainant can apply for an interim protection order at the Magistrates Court without giving prior notice to the respondent. The court can grant an interim order on the same day if it is satisfied that there is prima facie evidence that the respondent has committed an act of domestic violence and that the complainant or a child will suffer undue hardship if the order is not granted immediately. The interim order is served on the respondent by the Sheriff and remains in force until the return date, when both parties appear before the court.
Final Protection Orders
On the return date, the respondent has the opportunity to oppose the granting of a final protection order. If the respondent does not appear or does not oppose the application, the interim order is confirmed as a final order. If the respondent opposes the application, both parties present their evidence and the court determines whether a final order should be granted. A final protection order remains in force until it is set aside by the court.
Breach of a Protection Order
Where a respondent breaches a protection order, the complainant can hand a copy of the order and a sworn statement describing the breach to the police. The police are obliged to arrest the respondent without a warrant if they are satisfied that the respondent has breached the order. Breach of a protection order is a criminal offence carrying a fine or imprisonment. They will advise complainants on the steps to take when a protection order is breached and assist in ensuring that the breach is properly recorded and reported.
